Murphy Anderson Settlement for D.C. Construction Workers Approved by U.S. District Court for the District of Columbia

August 26, 2024

Judge Trevor N. McFadden of the U.S. District Court for the District of Columbia today approved a Fair Labor Standards Act (FLSA) Settlement Agreement negotiated by Murphy Anderson attorneys.

Murphy Anderson brought this collective action against Christian Siding, LLC, and general contractor Foulger-Pratt Contracting, LLC, on behalf of approximately 43 workers constructing the "Paxton," an affordable housing project located on Benning Road in Washington, D.C. This project received part of its funding from the District of Columbia and was required to follow the District’s prevailing wage schedules for the construction work.

The settlement reached with Christian Siding resolves the workers’ wage theft claims and recovers their unpaid wages for their construction work on the Paxton project. The Complaint alleged that the workers worked well more than 40 hours per workweek but were never paid overtime wages; were misclassified for their work on the project and were paid substantially below the prevailing rate and fringe benefits to which they were entitled.

The $900,000 settlement resolved all claims brought against the defendants.

Murphy Anderson attorneys Arlus Stephens, Mark Hanna, Nicole Rubin, and Ricardo Perez represented the workers.
