Federal Judge Dismisses Department of Labor Lawsuit against Union

U.S. District Judge James Gwin of the Northern District of Ohio today dismissed a lawsuit brought by the U.S. Department of Labor against a Murphy Anderson client.
The DOL's lawsuit asked the Court to overturn a union membership election under the Labor Management Reporting and Disclosure Act. The union denied that there were any problems with the election. In addition, the union argued that the DOL's lawsuit was based on an untimely filed administrative complaint; the DOL disagreed, arguing that the complaint was filed timely.
Judge Gwin agreed with the union's legal position and granted the union's motion to dismiss the DOL's lawsuit.
