Sarah Frazier presented at the ABA Health Law Section Emerging Issues in Healthcare Law Conference on the topic of “Off-Label Marketing Fraud’s Second Wave of FCA Cases: Declined but Mighty.”  Frazier discussed the evolution of off-label marketing cases since the Franklin v. Parke-Davis settlement relating to Neurontin. Frazier argued that while the U.S. hasn’t intervened in an off-label case in a few years, the cases continue to be viable, particularly when coupled with criminal enforcement, kickbacks, REMS violations (such as in Kennedy v. Novo Nordisk, relating to an Ozempic precursor), or patient harm. Whistleblowers continue to file these cases, and they’re proving that off-label marketing fraud has appeal to juries (e.g., Janssen, 2024, approximately $1 billion).

Mark Hanna presented at the ABA Labor and Employment Law Employment Rights & Responsibilities Committee Midwinter Meeting and National Symposium on Technology in Labor and Employment Law in Puerto Vallarta, Mexico on March 20. Hanna presented on the issue of misclassification claims of app-based workers, including those in the gig industry.

At the National Employment Lawyers Association (NELA) Wage and Hour Conference in St. Louis on March 28, Hanna spoke at the initial plenary “Protecting Workers in 2025 and Beyond” and also presented on a panel concerning cutting-edge state-law wage theft claims.
