D.C. FLSA Collective Action Certified against U.S. Security Associates, Inc. and Watkins Security Agency of DC

U.S. District Judge John D. Bates of the District of Columbia today certified a collective action under the FLSA and D.C. law and ordered court-facilitated notice to security guards who worked for two private contractors in the D.C. public schools. The guards allege that the contractors unlawfully reduced their pay on account of illusory "meal breaks." Judge Bates also denied the employers' motions to delay decision on certification until after they could take depositions of the guards.
