Murphy Anderson Attorneys Present at American Bar Association Labor and Employment Conference
Three Murphy Anderson attorneys presented at the American Bar Association annual Labor and Employment Law Conference in New York City.
Jason Veny presented on the “Recent Trends Challenging Mandatory Arbitration and Class Action Waivers” panel, which explored the consequences of the Supreme Court’s decision in Epic Systems v. Lewis. Panelists discussed worker action to push back against the prevalence of mandatory arbitration agreements and class action waivers, research regarding the outcomes of mandatory arbitration when compared to litigating the same claims in court, worker discontent with mandatory arbitration and employer benefits of mandatory arbitration.
Nicolas Mendoza presented on the “Whistleblower Retaliation 101” panel. The panel explained the basics of whistleblower retaliation law, such as the different types of whistleblower claims, the damages available in whistleblower retaliation cases, the adjudication of a whistleblower retaliation claim and the elements of whistleblower retaliation including discussion of causation standards and the U.S. Supreme Court decision in Murray v. UBS Securities, LLC. Mendoza focused on the False Claims Act’s retaliation provision as well as considerations when False Claims Act whistleblowers making fraud allegations also experience retaliation.
Mark Hanna presented on a panel discussing OSHA Hot Topics, including OSHA’s Walkaround Rule, OSHA’s proposed heat stress rule and state OSHA laws regarding workplace violence. Mark Hanna’s presentation focused the many OSHA-administered whistleblower laws.
